EDITORIAL: Jesus, no, but yes to Allah

Senate Democrats are proving once again that no judicial nominee is too extreme for them to stomach. A move seems to be afoot to open debate on the Senate floor this week on the nomination of David Hamilton of Indiana to the 7th Circuit U.S. Court of Appeals. This judge is a radical’s radical.
Alabama Sen. Jeff Sessions, the ranking Republican on the Judiciary Committee, sent a letter on Friday to his fellow senators outlining his objections to Mr. Hamilton, who is a federal district judge. The senator first objected to Judge Hamilton’s stated belief that judges should effectively amend the Constitution – “writing footnotes to the Constitution,” the judge called it – through evolving case law. Second, Judge Hamilton has publicly and specifically embraced the president’s “empathy standard,” which even Supreme Court Justice Sonia Sotomayor has now openly rejected.
Third, Judge Hamilton in many cases has shown an extreme hostility against innocuous expressions of religion in the public square. Mr. Sessions noted, though, that Judge Hamilton’s odd ruling in Hinrichs v. Bosma “prohibited prayers in the Indiana House of Representatives that expressly mentioned Jesus Christ … Yet he allowed prayers which mentioned Allah.”
Fourth, Mr. Sessions pointed out that “lawyers in the Almanac of the Federal Judiciary describe Judge Hamilton as one of the most lenient judges in his district on criminal matters,” including the case of a police officer who videotaped his own sexual encounters with two teenagers. The senator also objects to the judge’s extreme actions in blocking an “informed consent” law on abortion.
Finally, in light of the property rights movement stemming from the Supreme Court’s infamous Kelo decision, property rights advocates may want to take a close look at his representation of the city of Indianapolis in 1992 in Reel Pipe and Valve Co. V. City of Indianapolis, in which property owners were forced to sell property against their will to benefit other private “economic development.”
An Obama administration official has said the nomination is “a kind of signal” about the sorts of judges the president wants. In reviewing Judge Hamilton’s record, that signal should be seen as a red light warning senators to stop this nomination.

President Obama Announces David Hamilton for the United States 7th Circuit Court of Appeals
WASHINGTON, DC – Today, President Barack Obama announced his intent to nominate Judge David Hamilton to the United States 7th Circuit Court of Appeals. Hamilton has served for 14 years as a federal district judge in Indiana. He was appointed United States District Judge for the Southern District of Indiana in 1994 and was named Chief Judge in January of 2008.
President Obama said, “Judge Hamilton has a long and impressive record of service and a history of handing down fair and judicious decisions. He will be a thoughtful and distinguished addition to the 7th circuit and I am extremely pleased to put him forward to serve the people of Illinois, Indiana and Wisconsin.”
Hamilton previously was an associate and then partner at the Indianapolis firm of Barnes & Thornburg and served as Counsel to then-Governor Evan Bayh of Indiana. Hamilton served as a member of the Indiana State Recount Commission and as chairman of the Indiana State Ethics Committee.
“I enthusiastically support the Senate confirmation of David Hamilton for U.S. 7th Circuit Court of Appeals. Judge Hamilton has served the Southern District of Indiana with distinction as U.S. District Court Judge,” U.S. Sen. Dick Lugar said.

Hamilton is a graduate of Yale Law School and studied at the University of Tuebingen in Germany on a Fulbright scholarship. He is an emeritus member of the board of visitors of the Indiana University School of Law.

Leaders from Obama to Chavez blast Honduras coup
TEGUCIGALPA, Honduras – Police and soldiers clashed with thousands of protesters outside Honduras’ national palace Monday, leaving at least 15 people injured, as world leaders from Barack Obama to Hugo Chavez demanded the return of a president ousted in a military coup.
Leftist leaders pulled their ambassadors from Honduras and Nicaraguan President Daniel Ortega said El Salvador, Nicaragua and Guatemala would cut trade with neighboring Honduras for at least 48 hours. Venezuelan President Hugo Chavez called for Hondurans to rise up against those who toppled his ally, Manuel Zelaya.
“We’re ready to support the rebellion of the Honduran people,” Chavez said, though he did not say what kind of support he was offering…
“We believe that the coup was not legal and that President Zelaya remains the democratically elected president there,” Obama said…

…Second, we’re proposing a new and powerful agency charged with just one job: looking out for ordinary consumers. And this is essential, for this crisis was not just the result of decisions made by the mightiest of financial firms; it was also the result of decisions made by ordinary Americans to open credit cards and take out home loans and take on other financial obligations. We know that there were many who took out loans they knew they couldn’t afford, but there were also millions of Americans who signed contracts they didn’t always understand offered by lenders who didn’t always tell the truth. Even today, folks sign up for mortgages or student loans or credit cards and face a bewildering array of incomprehensible options. Companies compete not by offering better products, but more complicated ones, with more fine print and more hidden terms.
So this new agency will change that, building on credit card reforms I signed into law a few weeks ago with the help of many of the members of Congress who are here today. This agency will have the power to set standards so that companies compete by offering innovative products that consumers actually want — and actually understand. Consumers will be provided information that is simple, transparent, and accurate. You’ll be able to compare products and see what’s best for you. The most unfair practices will be banned. Those ridiculous contracts with pages of fine print that no one can figure out — those things will be a thing of the past. And enforcement will be the rule, not the exception.
For example, this agency will be empowered to set new rules for home mortgage lending, so that the bad practices that led to the home mortgage crisis will be stamped out. Mortgage brokers will be held to higher standards. Exotic mortgages that hide exploding costs will no longer be the norm. Home mortgage disclosures will be reasonable, clearly written, and concise. And we’re going to level the playing field so that non-banks that offer home loans are held to the same standards as banks that offer similar services, so that lenders aren’t competing to lower standards, but rather are competing to meet a higher bar on behalf of consumers.
The mission of this new agency must also be reflected in the work we do throughout the government. There are other agencies, like the Federal Trade Commission, charged with protecting consumers, and we must ensure that those agencies have the resources and the state-of-the-art tools to stop unfair and deceptive practices as well.
Third, we’re proposing a series of changes designed to promote free and fair markets by closing gaps and overlaps in our regulatory system — including gaps that exist not just within but between nations.
We’ve seen that structural deficiencies allow some companies to shop for the regulator of their choice — and others, like hedge funds, to operate outside of the regulatory system altogether. We’ve seen the development of financial instruments, like many derivatives, that are so complex as to defy efforts to assess their actual value. And we’ve seen a system that allowed lenders to profit by providing loans to borrowers who would never repay, because the lender offloaded the loan and the consequences to somebody else.
And that’s why, as part of these reforms, we will dismantle the Office of Thrift Supervision and close loopholes that have allowed important institutions to cherry-pick among banking rules. We will offer only one federal banking charter, regulated by a strengthened federal supervisor. We’ll raise capital requirements for all depository institutions. Hedge fund advisors will be required to register with the SEC.
We’re also proposing comprehensive regulation of credit default swaps and other derivatives that have threatened the entire financial system. And we will require the originator of a loan to retain an economic interest in that loan, so that the lender — and not just the holder of a security, for example — has an interest in ensuring that a loan is actually paid back. By setting common-sense rules, these kinds of financial instruments can play a constructive, rather than destructive role.
Over the past two decades, we’ve seen time and again, cycles of precipitous booms and busts. In each case, millions of people have had their lives profoundly disrupted by developments in the financial system, most severely in our recent crisis. These aren’t just numbers on a ledger. This is a child’s chance to get an education. This is a family’s ability to pay their bills or stay in their homes. This is the right of our seniors to retire with dignity and security and respect. These are American dreams, and we should not accept a system that consistently puts them in danger.
Financial institutions have an obligation to themselves and to the public to manage risks carefully. And as President, I have a responsibility to ensure that our financial system works for the economy as a whole.
There’s always been a tension between those who place their faith in the invisible hand of the marketplace and those who place more trust in the guiding hand of the government — and that tension isn’t a bad thing. It gives rise to healthy debates and creates a dynamism that makes it possible for us to adapt and grow. For we know that markets are not an unalloyed force for either good or for ill. In many ways, our financial system reflects us. In the aggregate of countless independent decisions, we see the potential for creativity — and the potential for abuse. We see the capacity for innovations that make our economy stronger — and for innovations that exploit our economy’s weaknesses.
We are called upon to put in place those reforms that allow our best qualities to flourish — while keeping those worst traits in check. We’re called upon to recognize that the free market is the most powerful generative force for our prosperity — but it is not a free license to ignore the consequences of our actions.
This is a difficult time for our nation. But from this period of challenge, we can once again tap those values and ideals that have allowed us to lead the global economy, and will allow us to lead once again. That’s how we’ll help more Americans live their own dreams. That’s why these reforms are so important. And I look forward to working with leaders in Congress and all of you to see these proposals put to work so that we can overcome this crisis and build a lasting foundation for prosperity.
Health Care Reform—Please Consider
Dear Readers,
It appears our new health care will be rationed as in other nations where you have to absolutely prove something is desperately wrong in order to see a doctor as in London (See Washington Post article at bottom of page). A lady was telling me about this the other day. She came to America and received the medical care she needed. She had been refused in London. She returned to London on Monday very thankful for the medical care currently available to everyone in America.
The saddest thing for Americans as of now—each of us will have to pay for baby murder. Also no conscious mercy refusal will be allowed. Medical staff will have to commit murder or lose their jobs in the name of abortion coverage.
We have to remember too that in the eyes of most democrats, anyone who is handicapped is considered disposable, as they should have been murdered at birth. “Quality of life” is motto of our day. America is becoming more Nazi in tune every day. We need to be in prayer for God’s perfect will for this nation that needs to fall on its knees in repentance for persistently doing it own thing.

A Canadian Doctor Describes How Socialized Medicine Doesn’t Work

I was once a believer in socialized medicine. As a Canadian, I had soaked up the belief that government-run health care was truly compassionate. What I knew about American health care was unappealing: high expenses and lots of uninsured people.
My health care prejudices crumbled on the way to a medical school class. On a subzero Winnipeg morning in 1997, I cut across the hospital emergency room to shave a few minutes off my frigid commute.
Swinging open the door, I stepped into a nightmare: the ER overflowed with elderly people on stretchers, waiting for admission. Some, it turned out, had waited five days. The air stank with sweat and urine. Right then, I began to reconsider everything that I thought I knew about Canadian health care.

Dealing with abortion in health care reform

While liberal Democrats on Capitol Hill are working to pass President Obama’s plan to overhaul the nation’s
Health care system, few are talking about this essential issue: Will health care reform force taxpayers to pay for abortions for the first time in 30 years?
The short answer is yes, because there is no explicit provision in the bill to:
• Prevent taxpayer funding of abortions as part of the health care benefit Congress is considering. It is ironic that taxpayer-funded abortions would be considered a “health care benefit” since the baby gets no health care benefit from abortion.
• Prevent delays in health care services that result in the death of the patient waiting for the care, usually the old, infirm and the very sick. In the Senate Committee on Health, Education, Labor and Pensions last week, an amendment to prevent the denial, delay or rationing of health care was defeated. Every Democratic senator on the committee voted not to prevent rationing.
• Allow health care providers, including doctors, nurses and pharmacists, to refuse to participate in any health care-related action that violates their conscience, be it an abortion or turning off a ventilator, denying or delaying care that will likely result in the death of a patient, or refusing to dispense an abortion-producing drug.
The entire political and legislative strategy of the health care reform bills being considered by Congress is to be simultaneously vague and to also empower the secretary of the Department of Health and Human Services to be “the decider” about almost everything.
The House health reform plan covers “family planning,” the well-worn buzz word that includes abortion unless specified to the contrary, and given the Democratic Party’s commitment to abortion, it would be naive to assume, unless there is an explicit prohibition in the bill, that Health and Human Services Secretary Kathleen Sebelius will not use her discretion to fund abortions with taxpayers’ money.
The fact that the word abortion does not appear in the legislative language makes this bill even more dangerous, since an unelected government bureaucrat will be defining what is or is not “family planning.” Watching Mr. Obama’s pro-abortion decisions thus far, it is not difficult to see a future, should this health care bill pass, where the unborn child enjoys not a shred of protection.
In short, the health care reform bills being considered in both the House and Senate attempt to be silent on the key question of whether or not to allow the U.S. Government to fund abortions with taxpayers’ money, while simultaneously giving the health and human services secretary the power to allow taxpayer-funded abortions.
A new Gallup poll, conducted in May, finds that 51 percent of Americans call themselves “pro-life” on the issue of abortion and 42 percent “pro-choice.” When it comes to taxpayer funding of abortion, the numbers of those who oppose this practice are even higher, topping 70 percent.
On the other key life-and-death decisions there is an active commitment on the part of Senate Democrats on the Health, Education, Labor and Pensions Committee to allow the rationing of health care.
This is what the White House and Congress mean when they say they will cut costs. It means cutting off your access to health care services by creating the legal authority to do so, while stopping any provision becoming law that would prevent rationing.
In a world of health care rationing, the elderly, the handicapped and the frail are the most likely to lose their lives because care was delayed or denied.
Among the life-and-death questions the American public must ask:
• Do you feel more comfortable handling decisions about who will get care now or later, or at all, or do you want to hand this power over to the government?
• Do you want Congress to allow taxpayer funded abortions?
• Do you think the government should force doctors and nurses to engage in acts they are fundamentally and ethically opposed to performing?
